Legal Alcohol Purchasing T&C’s.
In accordance with The Licencing (Scotland) Act 2005, It is an offence for a person under the age of 18 to buy or attempt to buy alcohol from this website. It is also an offence for any other person to purchase alcohol on behalf of somebody who is under the age of 18. Please note that where there is doubt as to whether a person attempting to buy alcohol on delivery is 18 or over, alcohol will not be sold to the person except on the production of evidence showing the person to be 18 or over. In the event that the purchaser appears under this legal age upon receipt of goods and cannot provide proof of age then the goods will be returned to us and you will receive a refund less any reasonable delivery and administrative costs. By placing an order for alcohol on the website www.miavino.com or any Mia Vino affiliated website you are adhering to this requirement and confirming that you are 18 years of age or the legal age to purchase alcohol within the country that you are purchasing the wine from. Mia Vino will at all times adhere to any legal restrictions imposed on us in connection with the sale of alcohol.

A European Union photocard driving licence
A PASS accredited proof of age card
A Ministry of Defence form 90 (Defence Identity Card)
A European member state national identity card or a national identity card from Norway, Iceland, Liechtenstein or Switzerland.

Contract
There will be no contract between you and Mia Vino until a 'confirmation of order' email has been sent to you. At any point until the dispatch of your order we reserve the right to cancel your order for any reason. By submitting payment details to Mia Vino you will be submitting an order which will incorporate all these terms. When you place an order you guarantee that you have the authority to accept and do accept our terms and conditions. You must be at least 18 years old to place an order with us. This contract is made on the terms of these conditions, which are governed by Scots Law, and the jurisdiction of the Scottish Courts.
Description & Prices
At Mia Vino we try our best to ensure that prices on our website are accurate at the time of placing your order. If by mistake, we have under or over-priced a product or service we will contact you as soon as possible and we may cancel your order provided we refund you any payments you have made or offer you the option of reconfirming your order at the correct price.
We reserve the right, at our discretion, at any time to amend our website prices , offers and products without prior notice. All prices quoted are subject to confirmation at time of order.
We have attempted to ensure that the description and specification of all products are correct and shown to the best of our ability.
Unless otherwise stated all alcohol prices are inclusive of UK duty and VAT. All prices are in £’s sterling including VAT (at 20%) and displayed as either per case or per bottle prices.
If you require a VAT invoice, select this option at the checkout or send us an email and we will be happy to email it over to you.
Ordering
There is no minimum order. Orders can be collected from our warehouse if this is chosen at check out. You must be of legal drinking age in your country of residence (18 in the UK) to order on this site.
When you place an order online you receive an email with the details. This acknowledges that your order has been received but not confirmed. Confirmation is subject to stock, payment, description and price verification and validation. Once this has been carried out, we send you a despatch confirmation email, and at that point your contract to purchase is complete. If there are any problems, we will contact you. We reserve the right to cancel any order at any time until the contract to purchase is complete. On receipt of your order confirmation email please check all details carefully, and contact us straight away at miavinouk@gmail.com if anything appears incorrect. By submitting payment details to Mia Vino you will be submitting an order which will incorporate all the terms stated under Terms & Conditions of the Mia Vino store and site.
We will cancel any order that fails our credit card fraud checks, or on the advice of our payment provider, the issuing bank or the cardholder. If an order is shown to be fraudulent, we will inform the police and cancel any further orders by the same customer.
We only accept orders for delivery to physical addresses. We do not accept orders for delivery to P.O. boxes.
Special Offers/Promotions.
Special offers are subject to availability at time of going on offer and we reserve the right to terminate/withdraw any special offer/promotion at any time, without prior notice. Promotion offers from Mia Vino do not have a cash value..
How to Pay
We accept all major credit/debit cards in person: Visa, Maestro, American Express and Mastercard.
Online payments are made using a secure payment encryption via Paypal.
Delay or Diverting an Order
Should you wish to delay, divert or stop delivery of your wine order this must be done immediately and in writing to miavinouk@gmail.com. We will do our best to accommodate your needs depending on the status of your order. As we process payment as soon as your order has been confirmed, your account is immediately debited to the sum of your order value and we can not refund. Therefore cancelling an order constitutes non delivery of product not a cash refund.
Returns/Cancellation
UK Consumer Contract Regulations Cancellations
Under the UK’s Consumer Contracts Regulations, you have the right to cancel your entire order and receive a full refund, excluding delivery charge, for up to fourteen days beginning from the day on which you receive the goods. To exercise this right, you must inform us of your decision to cancel your contract by a clear statement, including details of your name, geographical address, details of the order you wish to cancel and, where available, your phone number and email address. You must then arrange to have the goods returned to us at the above address. You are required to take reasonable care of the goods while they are in your possession. Goods must be returned to us in their original condition, unopened, with labels intact. If goods are returned in an unacceptable condition or damaged with the customer at fault then the customer will be liable for the cost of damage and pursuit will be made to recover any financial loss to Mia Vino. Your refund will be issued via your original payment method.
Any cancelled order wishing to be returned to Mia Vino will be at your own cost and we recommend the use of a registered postal service for your protection. If you prefer we can organise this for you through our courier and reduce the cost of this from your refund if preferred. You have 28 days to return the goods to us following the agreed cancellation date. If the customer fails to return the goods within the 28 days, Mia Vino will be entitled to deduct the cost of recovering the goods from the customer.
Stock Availability
On occasion, Mia Vino may not have certain items in stock, without notice. If this ever happens we will contact you to discuss your order and either recommend a different product, issue a refund or see if a later delivery date would be appropriate. Mia Vino accepts no liability from any inability to supply due to stock issues.
Corked & otherwise faulty wine.
If we find that a wine is corked or faulty in some way, we will issue a credit note for Mia Vino when the bottle is returned. The wine must have been purchased in the past 4 months and stored properly. If you think there is a problem, contact us within 48 hours.
All credits for corked or otherwise faulty wine are issued at Mia Vino discretion.

Receipt of Goods / Delivery
All deliveries must be signed for by an adult of legal drinking age in the country of purchase and delivery (18 in the UK).
Deliveries to G and PA postcodes will be made within 7 working days of your order being placed (Monday - Friday).
Deliveries to ML postcodes will be made within 5 working days of your order being placed (Monday - Friday).
Delivery times are estimates and not guarantees. We try to ensure all deliveries arrive on time.
When you receive your delivery we ask that you immediately check it is correct and not faulty or damaged. You will be asked to sign for your delivery. When you sign for your delivery we assume they have been delivered in good condition, even if you have not checked them. If any or part of your order has been damaged, we will give a refund for the damaged items. You must refuse to accept the delivery or make it known to the driver you have noticed a fault.
If you receive the wrong products, we will issue a replacement (subject to stock) or you can return them to us and we will issue a refund.
If you order a pick-up from Mia Vino, you must bring photographic ID, and your confirmation email - the names must match.
This does not affect your statutory rights.
We will not leave alcohol in any safe place or with a neighbour - the purchaser must accept delivery in person and show proof of ID.
Delivery charges
Delivery charges will be applied at the checkout. We deliver to ML1, ML2, ML3, ML4, ML5, ML6, ML7, ML8, ML9, ML10, ML11, ML12, G1, G2, G3, G4, G5, G11, G12, G20, G41, G42, G43, G44, G46, G52, G64, G71, G72, G73, G74, G75 and PA1 only.
Deliveries to G and PA postcodes will be made within 7 working days of your order being placed (Monday - Friday).
Deliveries to ML postcodes will be made within 5 working days of your order being placed (Monday - Friday).
Please do not place an order for deliveries outside these areas.
If you would like to place an order outside of these areas you can send an email to miavinouk@gmail.com for more information on how we can arrange a delivery for you.
If you have selected a postcode which doesn’t match the delivery address we will call or email you to cancel the order and arrange a refund or collect/refund the difference in price before delivery.
Governing Law
This contract for the sale and purchase of goods ordered shall be governed by and construed in all respects in accordance with Scots law and the Scottish Courts shall have jurisdiction to resolve any disputes between us.
Website Use
The following terms and conditions will apply to: (a) your use of our website; (b) our supply of products and services; and (c) our dealings with you. By entering, accessing or using our website in any way, you agree to comply with our terms and conditions. If you do not accept our terms and conditions in full, you must stop using our website immediately. It is a condition of use of this website that only people aged 18 or over are allowed to use/purchase.
Disclaimer of Warranty
Separate terms and conditions may apply to certain products, services and materials available through this website. If this is the case this will be brought to your attention. Subject to this, no express or implied warranties of any kind are made in respect of this website or the products, services and materials available through it.
Mia Vino does not warrant that this website will operate uninterrupted or error/virus free or that the information on this website is accurate or complete.
Data Protection
Any personal information you submit to Mia Vino will be dealt with in accordance with our Privacy Policy.
